Deposits and Reserved Time 

Upon payment of this invoice, Molly Morgan Photography LLC. will reserve the time agreed upon and will not make another reservation for the specific time frame. 

Contract for Services 

Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of Molly Morgan Photography LLC. and unless Photographer provides written consent, such proofs or prints may not be used for advertising, display or any other purpose other than personal enjoyment as described in the section “Client’s Usage.”

If there is inclement weather on November 27, 2022 the Parties shall make every attempt to reschedule the photo session. If the photo session cannot be rescheduled for the following day due to inclement weather or if either party becomes sick, the Photographer will communicate with client(s), and another plan will be devised. 

If photographers cannot perform this Contract in whole or in part due to a cause beyond the control of the parties, changing of details that no longer fit with the photographers’ originally agreed terms or due to Photographer’s illness or injury, then Molly Morgan Photography LLC. will return all fees to the client(s) but shall have no further liability with respect to this Agreement. This is the parties’ entire agreement on this matter, superseding all previous negotiations or agreements.

Receiving Your Edited Images 

Please allow up to 15 days to receive the online gallery.

Coloring and Retouching

Basic retouching includes clearing skin, getting rid of flyaways and single strands of hair in the face and obvious blemishes. Basic retouching does not include things like physically changing body shapes, fixing dresses, fixing clothes/makeup/etc. or adding things to photos. 

The Client agrees to pay $10 per image for extra retouching not specified in this section. 

Colors and Styles

Clients may choose between colored or original photos. By default, colored photos will be given. If for any reason the client does not want their photos colored, they will receive original tones brightened and edited slightly. If neither colored nor original versions are satisfactory, the client agrees to pay a separate charge of $10 per image for additional coloring choices to be presented. By choosing Molly Morgan Photography LLC. you acknowledge the style and colors used and agree to allow the photographer to choose the colors based on personal preference.

Overall Appearance and Personal Items 

The photographer is not responsible for any missing, damaged or altered clothing/material belonging to the client. Please be aware that for some photos you may or may not get dirty. It is ultimately your responsibility to make sure your clothes, makeup, hair and overall appearance are the way you want for the photos. The photographer is not responsible for any styling, makeup issues, hair problems or any other factors in the photography other than the directing and photography of the client.

Clients Cooperation 

Deliverable items and shots are contingent upon the client performing actions and cooperating with the photographer. 

Digital Files

CDs are not available through Molly Morgan Photography LLC. All files will be sent digitally and will be made available for download. Prints can be ordered through Molly Morgan Photography LLC. A 1 year access to the online digital gallery of images will be granted to client(s), which shall begin on the date the Client is provided access to the online digital gallery. Client(s) agree to download their images to their personal devices and also agree they are responsible for downloading and saving their images before the 1 year access of the gallery is over. Molly Morgan Photography LLC. does not guarantee the possession of said images beyond 1 year of session or event date. Upon retirement of an online digital gallery, client(s) will be presented with the option to purchase a longer access time to the online gallery, however this is not guaranteed and it is highly recommended that the client(s) download their images (for lifelong access and memories) in a timely manner. 

Refunds 

If the client is not  satisfied with their photos, the client will be refunded half of the total amount agreed upon if the issue stems on the photographer(s) end. The client will only be eligible if they have made this known to the photographer within 48 hours of having received the finished gallery and only at the Photographer’s reasonable discretion. If the client chooses to re-do their  photos for any reason, it will be considered as a new session and the client will need to purchase a new package. The deposit is non-refundable. In the event of an emergency, equipment failure or other unforeseen circumstances, the photographer will return any money given up to that point but claims no further liability. Client(s) agree that an entire wedding/event cannot be replicated, reenacted or repeated for the purpose of a re-shoot. 

Clients Usage

The Client is obtaining downloads and prints for personal use only. Client shall have unlimited printing rights and sharing rights, including but not limited to sharing and posting digital images. When the Client is provided access to the online digital gallery, the Photographer shall also provide Client written permission to print all images provided to Client for such personal use described herein. Unless Photographer provides written consent, Client shall not: sell said prints and is not permitted to give photos to vendors having their products or setups photographed in order to use for advertising or promotion; and no commercial use is granted by the issuance of print or digital photos. 

Exclusivity 

It is understood and agreed that no other photographer will be allowed to photograph or take pictures while the Photographer is working. The Photographer shall be the exclusive photographer retained by the Client(s) for the purpose of photographing the event/session. Guests, Family and friends of the Client(s) shall be permitted to photograph as long as they shall not interfere with the Photographer’s duties.

Model Release  

The Clients grant the Photographer and its legal representatives, heirs and assigns,

the irrevocable and unlimited consent to use the photographs of the Clients for editorial,

competition, advertising and any other purpose and in any manner, to alter the photographs

without restriction; and to copyright the images. The Clients hereby release the Photographer and

its legal representatives, heirs and assigns from all liability and claims in connection with the images.
